International clients · Turkish law

Turkish law, for clients outside Türkiye.

You own or intend to buy property in Türkiye, trade with Turkish companies, hold a judgment against a Turkish debtor, inherit from a Turkish relative, or ran into a legal problem while visiting. This page sets out how such matters are handled under Turkish law, what documents and time limits apply, and how we work with clients who are not in the country.

Özdamar & Partners is a law office founded in 2006 in Sivas, central Anatolia, with a liaison address in Istanbul. We advise companies and individuals in commercial, corporate, employment, real estate, inheritance and criminal matters under Turkish law, across the whole of Türkiye. We advise exclusively on Turkish law; correspondence is conducted in English and German. Turkish-origin citizens living abroad will find a dedicated Turkish-language guide here.

I.

II.

Buying property in Türkiye as a foreign national

Foreign natural persons who are nationals of the countries designated by presidential decision may acquire real estate and limited rights in rem in Türkiye, subject to statutory limits on the total area that may be acquired and to restrictions in military forbidden zones, military security zones and strategic areas (Land Registry Law No. 2644, Article 35). Foreign companies acquire property only within the framework of special laws; companies incorporated in Türkiye with foreign shareholders are subject to a separate authorisation regime. Ownership passes solely by registration at the land registry office (tapu). A private sale agreement, a reservation form or a payment receipt does not transfer title.

  1. 1

    Due diligence on the title

Before any payment, the land registry record is examined for mortgages, attachments, annotations and easements; the zoning status and the building's occupancy permit are checked with the municipality; it is confirmed whether the unit is registered as a condominium ownership (kat mülkiyeti) or only as a construction servitude (kat irtifakı), and whether the seller is the registered owner. The property must lie outside military and security zones; the land registry obtains this confirmation.

  2. 2

    Contract and deposit

Preliminary sale contracts (satış vaadi) are valid only if executed before a notary and may be annotated in the land registry for protection. Deposits paid to agents or developers against informal reservation forms are the most frequent source of loss. Estate agents' commission is capped by regulation at four per cent of the sale price plus VAT, shared between the parties unless agreed otherwise.

  3. 3

    Valuation, payment and taxes

Foreign buyers must obtain a valuation report from a licensed appraiser, which also determines the minimum basis for title-deed fees. The purchase price must be brought into Türkiye in foreign currency and converted through a Turkish bank, which issues a foreign-exchange purchase document required by the land registry. Title-deed fee (currently four per cent of the declared value, in practice split between buyer and seller), compulsory earthquake insurance (DASK) and a Turkish tax number are required at completion.

  4. 4

    Completion at the land registry

Completion takes place at the land registry office in the presence of the parties or their attorneys under a power of attorney, with a sworn interpreter where a party does not speak Turkish. Payment and registration should be synchronised; we recommend payment by bank transfer upon registration or through a blocked account.

  5. 5

    After completion

Registration of utilities, annual property tax (declared at the municipality), building management dues and, where applicable, the rules of the condominium (kat mülkiyeti). Holding the property for a prescribed period and above a prescribed value may qualify for Turkish citizenship by investment under conditions set by regulation, which change from time to time and should be verified at the time of purchase.

RiskWhat it looks likeHow it is managed
Off-plan and developer projectsPayment schedules before the building exists; the land belongs to a third party under a build-and-share agreement; the unit is not yet registered.Review of the developer's title and the land-share agreement, notarised preliminary contract with land-registry annotation, staged payments against construction milestones, penalty and delivery clauses.
Occupancy and zoningBuilding without an occupancy permit (iskân), illegal extensions, agricultural or forest land sold as building plots.Municipal zoning inquiry, occupancy permit check, cadastral boundary verification before contract.
Timeshare and holiday-club contractsHigh-pressure sales presentations, long-term contracts with annual charges, no registered right in the property.Statutory right of withdrawal under consumer law; review of what right, if any, is actually conveyed; termination and refund claims.
Inheritance consequencesTurkish law governs succession to immovable property in Türkiye regardless of the owner's nationality. Will drafted in a form valid under Turkish law, ownership structure planned at purchase, heirs informed of the three-month renunciation period.
ResellingCapital gains on a sale within five years of acquisition are taxable in Türkiye; transfer of the proceeds abroad requires bank documentation.Tax position reviewed before sale; sale conducted under a power of attorney without travel.
III.

Letting your property while living abroad

Turkish tenancy law protects residential and commercial tenants to a considerable degree. A lease does not end simply because its term expires: it is renewed automatically for one year at a time, and the landlord may terminate only on the grounds listed in the Code of Obligations (Articles 339 et seq.). Annual rent increases are capped at the twelve-month average of the consumer price index; a deposit may not exceed three months' rent and must be placed in a bank account; before any eviction or rent dispute reaches court, mediation is mandatory. Short-term holiday lets of up to one hundred days require a tourism rental permit under Law No. 7464 and carry administrative fines without it. Rental income of non-resident owners is taxable in Türkiye as limited taxpayers, subject to the double-taxation treaty with your country of residence.

Tenant vetting and contract

Before the keys are handed over

Credit-bureau (Findeks) report and enforcement-record check of the prospective tenant, a lease drafted for the specific property rather than a stationery-shop form, deposit and guarantor arrangements, and an eviction undertaking taken in a form that will hold up in court.

Rent collection and notices

Every month, in writing

Monthly monitoring of payment into your account, written reminders, thirty-day statutory notices on default, calculation and notification of the annual increase, and a documented record of two justified notices within a lease year, which is itself a ground for eviction.

Enforcement and eviction

If the rent is not paid

Enforcement proceedings with a request for eviction, eviction and rent-determination actions, recovery of arrears, handover and deposit settlement at the end of the lease, all conducted under your power of attorney without your presence.

Rental management at a fixed monthly fee

For owners living abroad we offer the legal management of the tenancy as a single service, wherever in Türkiye the property is located: tenant vetting, a property-specific lease, eviction undertaking, deposit and guarantor arrangements, monthly rent monitoring, notices, enforcement and eviction proceedings, and a written monthly report. The fee is twelve per cent of the annual rent, payable in twelve equal monthly instalments; court fees, notary and service costs are charged at cost. Finding the tenant and advertising the property is estate-agency work, which we do not undertake; our service begins with the legal assessment of the candidate.

IV.

Problems while visiting Türkiye

Most legal problems encountered by visitors can be pursued after returning home, provided the evidence was secured on the spot. The table below lists the most frequent situations, the first step to take while still in Türkiye, and what can be done afterwards from abroad.

SituationWhile still in TürkiyeFrom abroad
Traffic accidentPolice or joint accident report, photographs, the other vehicle's registration and insurance policy number, medical examination the same day even for minor injuries.Claims for vehicle damage, treatment costs, loss of earnings and non-pecuniary damages against the liable driver's compulsory insurer; where the vehicle is uninsured or unidentified, against the Guarantee Account. Claims are filed with the insurer first and, if rejected, before the Insurance Arbitration Commission or the courts.
Injury at a hotel, pool or excursionWritten incident report from the hotel or tour operator, medical records, witness contact details, photographs of the place and the cause.Liability of the hotel, tour operator and, under package-travel rules, the organiser; claims for treatment costs, disability and non-pecuniary damages; parallel claims against the travel agency in your home country may exist and are coordinated with your local lawyer.
Car rental disputesPhotographs of the vehicle at pick-up and return, the signed condition report, receipts; do not sign blank damage forms.Challenge of unauthorised card charges for alleged damage, fuel or fines; consumer arbitration committee claims below the annually updated threshold; court actions above it.
Hospital bills and medical treatmentItemised invoice, treatment records, contact with your travel insurer before discharge; private hospitals may not withhold medical records.Disputes over excessive charges, insurer reimbursement, and claims for medical negligence, which are examined by the Council of Forensic Medicine or university experts.
Theft, lost passport, fraudPolice report (the report number is needed for insurance and for your consulate), card cancellation, consular emergency travel document.Criminal complaint pursued through a lawyer, participation in the proceedings as victim, civil recovery of amounts obtained by fraud.
Questioning, detention or arrestYou are entitled to a lawyer from the first questioning, to an interpreter, to remain silent and to have your consulate notified (Vienna Convention on Consular Relations, Article 36). Do not sign a statement you have not understood.Representation throughout the investigation and trial, objections to detention and to travel bans imposed as judicial control, and a safe-conduct application for a defendant who has left Türkiye (see section VIII).
Overstaying, residence and entry bansPay any overstay fine at departure to avoid an entry ban; keep receipts.Applications against entry bans and administrative fines under the Law on Foreigners and International Protection; administrative court actions within the statutory period.

Limitation periods for tort claims in Türkiye are generally two years from knowledge of the damage and the liable person, and in any event ten years; claims under insurance contracts and package-travel contracts have their own periods. Securing the police or incident report before leaving the country is in practice decisive.

V.

Business with Turkish counterparties

Contracts

Sale, distribution, agency, services

International sales contracts with Turkish buyers or suppliers are governed by the UN Convention on Contracts for the International Sale of Goods (CISG) unless excluded; Incoterms, governing law and the dispute-resolution clause (Turkish courts, ISTAC or ICC arbitration) should be chosen deliberately. Turkish agency law grants the agent a mandatory goodwill indemnity on termination (Commercial Code, Article 122), which courts apply by analogy to exclusive distributors; post-termination non-compete clauses are limited to two years and must be in writing.

Debt recovery

Enforcement without a judgment

Turkish law allows enforcement proceedings to be commenced on an invoice or contract without a prior judgment. The debtor has seven days from service of the payment order to object; if no objection is filed, the proceedings become final and attachment follows. On objection, the creditor brings an action to annul the objection, preceded by mandatory mediation for commercial monetary claims (Commercial Code, Article 5/A); a debtor whose objection is found unjustified pays a statutory penalty of at least twenty per cent of the claim.

Company formation

Limited company, joint-stock company, branch

Foreign investors establish companies on the same terms as Turkish nationals (Foreign Direct Investment Law No. 4875). The limited company (limited şirket) and the joint-stock company (anonim şirket) are the usual forms; incorporation, registration with the trade registry and bank-account opening are completed under a power of attorney. Branches and liaison offices of foreign companies are subject to separate registration and, for liaison offices, ministry authorisation. Joint-stock companies above a statutory capital threshold must retain a contracted lawyer.

Employees and local management

Employment law, work permits, directors' liability

Turkish subsidiaries employ staff under the Labour Code, with employment protection applying from thirty employees, mandatory severance pay and strict formal requirements for dismissal. Foreign employees require work permits. Managing directors are personally liable for unpaid taxes and social security contributions of the company, which makes the choice and supervision of local management a legal as well as a commercial question.

Where a Turkish counterparty enters restructuring (concordat) or bankruptcy, creditors must file their claims within short statutory periods and may need to vote on the restructuring plan; we represent foreign creditors in these proceedings. Our Turkish-language guides on company law and retained corporate advice describe our domestic practice in more detail.

VI.

Recognition and enforcement of foreign judgments and arbitral awards

A judgment of a foreign court has no effect in Türkiye until a Turkish court has granted recognition (tanıma) or enforcement (tenfiz). The procedure is governed by the Private International Law and Procedure Act (Law No. 5718, Articles 50 to 59); foreign arbitral awards are enforced under the 1958 New York Convention, to which Türkiye is a party, and Articles 60 to 63 of the same Act. The Turkish court does not review the merits of the foreign decision.

QuestionForeign court judgmentForeign arbitral award
Competent courtCivil court of first instance at the respondent's domicile or residence in Türkiye; failing that, the courts of Ankara, Istanbul or Izmir (Art. 51).Same rule (Art. 60).
DocumentsCertified copy of the judgment, certificate of finality, apostille and sworn Turkish translations (Art. 53).Original or certified copy of the award and of the arbitration agreement, with sworn translations (Art. 61).
Conditions examinedReciprocity with the state of origin (treaty, statute or practice); no exclusive Turkish jurisdiction; no manifest breach of public policy; the respondent was duly summoned or represented (Art. 54). Reciprocity is not required for mere recognition (Art. 58).Grounds for refusal under Article V of the New York Convention and Article 62: invalid arbitration agreement, breach of the right to be heard, excess of mandate, award not yet binding or set aside, public policy.
Procedure and durationSimplified procedure with a hearing; the respondent is served with the application. Service abroad lengthens the proceedings considerably; where the respondent has a Turkish address or a Turkish lawyer, several months are typical. Appeal lies to the regional court of appeal.Same procedure; the respondent may raise only the Convention grounds.
After the decisionOnce final, the enforcement judgment is executed like a Turkish judgment: attachment of bank accounts, real estate, vehicles and receivables through the enforcement office.Same.

Foreign divorce decrees involving a Turkish spouse may be registered directly in the Turkish civil registry on a joint application by both former spouses or their attorneys, without a court action, provided the decree is final and not manifestly contrary to Turkish public policy (Civil Registry Services Law No. 5490, Article 27/A). Where the other spouse does not cooperate, a recognition action before the family court is required.

VII.

Inheritance and family matters with a Turkish element

Succession to property in Türkiye

Law No. 5718, Art. 20; Civil Code Art. 598 et seq.

Succession is governed by the national law of the deceased, but immovable property in Türkiye is always governed by Turkish law, including its forced-heirship rules. Foreign heirs obtain the certificate of inheritance from the civil court of peace (notaries may not issue it to foreigners); the inheritance may be renounced within three months of learning of the death; an inheritance tax return is due within four to eight months depending on the place of death and the heir's residence; transfer of title to the heirs is registered at the land registry under a power of attorney. Where a Turkish relative disposed of assets during their lifetime to the detriment of forced heirs, abatement (tenkis) and sham-transfer actions are available within statutory periods.

Wills and estate planning

Form and substance

A will is valid as to form if it complies with the law of the place where it was made, with the national law of the testator or with Turkish law. Owners of Turkish property who wish to control its devolution should have a will drawn up that is valid under Turkish law, taking into account the reserved portions of spouse and descendants, and should consider the ownership structure at the time of purchase.

Marriage and divorce

Civil Code Art. 161 et seq.; Law No. 5718 Art. 13, 14

Divorce between a foreign national and a Turkish citizen may be brought in Türkiye where one spouse is domiciled or the last common residence was here. The default matrimonial property regime under Turkish law is participation in acquired property; assets acquired during the marriage are shared on divorce, subject to the law applicable to the regime. Foreign divorce, custody and maintenance orders are recognised and enforced as described in section VI.

Children

Custody, contact, maintenance, abduction

Custody and contact orders are made in the best interests of the child; international child abduction cases are handled under the 1980 Hague Convention through the Turkish central authority and the family courts, with strict time limits. Maintenance orders from abroad are enforced under the applicable conventions and the enforcement procedure.

VIII.

Criminal proceedings involving foreign nationals

A foreign national may become involved in Turkish criminal proceedings as a suspect, as a defendant who has already left the country, or as the victim of an offence committed in Türkiye, most often fraud connected with property purchases, investments or online transactions.

If you are questioned or charged

Code of Criminal Procedure

Right to a defence lawyer from the first questioning, to a court-appointed interpreter, to silence and to consular notification. Detention on remand is reviewed at regular intervals and may be challenged within two weeks; judicial control may include a ban on leaving the country, which can be challenged separately.

If you have left Türkiye

Articles 244 to 248

A defendant abroad who cannot be reached may be declared absent or fugitive; an arrest warrant is executed at the border, and assets in Türkiye may be seized. The court may issue a safe-conduct assurance (güvence belgesi) that the defendant will not be detained if they appear; we examine the file through the court system and advise on the risks before any travel.

If you are the victim

Complaint and participation

A criminal complaint is filed with the public prosecutor through a lawyer; the victim may participate in the trial, request evidence, object to a decision not to prosecute within two weeks, and pursue civil recovery. In fraud cases connected with property or investment schemes, early seizure of the proceeds is the decisive step.

Transfer of sentenced persons and mutual legal assistance between Türkiye and other states are governed by the Law on International Judicial Cooperation in Criminal Matters (No. 6706) and the applicable conventions; we advise on the Turkish side of such requests.

IX.

How we work with clients abroad

  1. 1

    First consultation by video call

You send the documents in advance (title deed, contract, judgment, correspondence, police report); in a video call scheduled across time zones we identify the applicable procedure, the time limits and the documents required, and give you a written summary afterwards.

  2. 2

    Power of attorney

Issued either at a Turkish consulate in your country, where it is drawn up in Turkish and can be used directly, or before a local notary, in which case it is apostilled under the 1961 Hague Convention and translated by a sworn translator in Türkiye. We prepare the text so that the powers required for your matter (which Turkish procedural law demands be expressly stated, for example for settlement, waiver, divorce or land-registry transactions) are included.

  3. 3

    Conduct of the matter

Court and enforcement filings, land-registry and civil-registry transactions are made by us under the power of attorney. Service of process is made on us, which removes the months of delay that service abroad entails. The file is followed through the national judicial network (UYAP) and you receive a written report on every development.

  4. 4

    Hearings

Civil courts may, on application, allow a party or their lawyer to attend a hearing by simultaneous audio and video link (Code of Civil Procedure, Article 149). Most civil and enforcement matters are concluded without the client ever attending; the few steps that require your presence, such as certain criminal hearings or a land-registry completion without a power of attorney, are planned around your travel.

  5. 5

    Outcome and funds

Judgments are enforced, amounts recovered are transferred to the account you designate with the bank documentation required for international transfers, and title or registry changes are completed and documented to you.

Turkish law only

We advise exclusively on Turkish law. Where your home-country law is also engaged, we coordinate with your local lawyer and confine ourselves to the Turkish side of the matter.

Confidentiality

Everything you tell us is protected by the lawyer's duty of professional secrecy under Article 36 of the Turkish Attorneys' Act. Conflicts of interest are checked before we accept any instruction.

Written advice, realistic prospects

Our advice is given in writing, with the applicable provisions and the practical prospects stated plainly, including where a claim is not worth pursuing in Türkiye.

Languages and availability

Correspondence in English and German; video calls scheduled to your time zone; written questions answered within one business day; an out-of-hours contact for detention and other urgent matters.

X.

Fees

Fees are agreed in writing before any work begins. Depending on the matter, we work on a fixed fee for a defined scope (for example a property purchase, an enforcement action or the recognition of a judgment), on an hourly basis for advisory work, or on a monthly retainer for ongoing matters such as rental management or corporate advice. Turkish professional rules prohibit fees below the minimum tariff published annually by the Union of Turkish Bar Associations and restrict purely contingent arrangements.

Included in the fee

Advice, drafting, filings, correspondence, hearings and reporting within the agreed scope.

Charged at cost

Court fees and expenses, enforcement office charges, notary and apostille fees, sworn translations, expert and valuation reports, travel outside Sivas and Istanbul.

Recovered from the other side

Where a case is won, the court orders the losing party to pay a statutory contribution to the winner's legal fees and costs; this is separate from, and does not replace, the fee agreed with us.

Payment is made by international bank transfer to our account in Türkiye; invoices are issued in Turkish lira with the equivalent in your currency stated for reference. An estimate of total fees and costs is provided before you decide to proceed.

Frequently asked questions

Can you handle my matter without my travelling to Türkiye?

Yes. A power of attorney issued at a Turkish consulate, or before a notary in your country with an apostille and a sworn Turkish translation, allows us to file and conduct court cases, enforcement proceedings, land registry and inheritance transactions on your behalf. Service of process is made on us, the file is followed through the national court system (UYAP), and courts may allow parties to attend hearings by video link. The few steps that require your presence are identified at the outset.

Can a foreign national buy property in Türkiye?

Nationals of the countries designated by presidential decision may acquire real estate in Türkiye, subject to statutory area limits and to restrictions in military and security zones (Land Registry Law No. 2644, Article 35). Before signing anything, the title should be checked for encumbrances, zoning status and occupancy permit; a licensed valuation report and payment through a Turkish bank with a foreign-currency purchase document are required for foreign buyers. Title passes only by registration at the land registry, never by a private contract.

I obtained a judgment or an arbitral award abroad against a Turkish company. How do I enforce it?

Foreign court judgments are enforced through an enforcement (tenfiz) action before the Turkish civil court of first instance under the Private International Law Act (Articles 50 to 59); foreign arbitral awards are enforced under the 1958 New York Convention and Articles 60 to 63 of the same Act. The claimant files the certified judgment or award with a certificate of finality and sworn translations. The court does not re-examine the merits; it checks reciprocity for judgments, jurisdiction, public policy and the respondent's right to be heard.

What time limits should I be aware of?

Several deadlines are short: an objection to a payment order in enforcement proceedings must be filed within seven days of service; an appeal against a first-instance judgment within two weeks of service of the reasoned judgment; renunciation of an inheritance within three months; a written answer to a statement of claim within two weeks. Service abroad takes months, but once a Turkish lawyer is appointed, service is made on the lawyer and the deadlines run from that date.

How are your fees determined?

Fees are agreed in writing before work begins, either as a fixed fee for a defined matter or on an hourly basis, and never below the minimum tariff published annually by the Union of Turkish Bar Associations. Court fees, notary, translation and expert costs are separate and are itemised in advance. Where a case is won, the court orders the losing party to pay a statutory contribution to legal fees; this is distinct from the fee agreed with us.

Do you advise on German, Austrian or other foreign law?

No. We advise exclusively on Turkish law. Where a matter also involves the law of your home country, we work alongside your local lawyer and coordinate the Turkish side of the matter. Correspondence can be conducted in English and German.

I was involved in an accident or a dispute while on holiday in Türkiye. Can I pursue it after returning home?

Yes. Claims arising from traffic accidents, injuries at hotels or on excursions, defective tourism services, car-rental disputes and consumer complaints can be pursued through Turkish insurers, consumer arbitration committees and courts after you have returned home, provided that the evidence was secured at the time: police or accident report, medical records, photographs, receipts and the contact details of witnesses. Limitation periods vary from two years for most tort claims to longer periods for contractual claims.

My spouse or parent was a Turkish citizen. Does Turkish law apply to the inheritance?

Succession is governed by the national law of the deceased; immovable property located in Türkiye is, however, always governed by Turkish law (Private International Law Act, Article 20). Foreign heirs obtain the certificate of inheritance from the civil court of peace rather than from a notary, may renounce the inheritance within three months, and must file an inheritance tax return within four to eight months depending on where the death occurred and where the heir resides.

Where are you located, and does it matter for my case?

Our office is in Sivas, in central Anatolia, with a liaison address in Istanbul. Turkish lawyers may appear before any court in the country, and filings, service and case monitoring are electronic. We conduct matters in every province; where a hearing requires personal attendance, we attend in person. Fees do not depend on where in Türkiye your matter is located, except for travel costs, which are agreed in advance.
